Other professional services specific to the insolvency proceedings
Exclusive powers of the practitioner in insolvency are:
- notifying creditors, preparation of tables of claims, filling the appeals to the statements of claim,
- convoking and chairing meetings of creditors, shareholders or members or members of debtor- legal person, if the law does not give these powers to burden others,
- the sale of property assets of the debtor and any procedures relating thereto;
- developing legal reorganization plan of the debtor, under the conditions and terms provided by Law no. 85/2006;
- monitoring the debtor's assets management operations;
- leadership, in whole or in part, of the activity of the debtor, where the law or syndic judge sets this task to insolvency practitioner;
- ending transactions, debt discharge, waiving collateral, under Law no. 85/2006;
- distributing sums from liquidation;
- signing liquidation balance;
- bringing actions for annulment of fraudulent acts concluded by the debtor to harm creditors and patrimonial character transfers, commercial transactions concluded by the debtor and the formation of guarantees given by it, which could prejudice the rights of creditors;
- developing and supporting periodic reports in insolvency procedure;
- developing expertise on activities included in insolvency proceedings, at the request of the syndic judge or other judicial bodies, including criminal prosecution.
